General Sales Terms and Conditions

We ask that you read attentively the general sales terms and conditions. Before any purchase, our clients are expected to have read, understood and accepted the general sales terms and conditions. Any purchase of alcoholic products is forbidden to clients aged under 16. This needs to be specified in the field “registration of your coordinates”.

Telephone Orders
It is possible to order by phone as per the delivery and payment conditions as stated in the general sales terms and conditions and according to the arrangements made by phone.

Minimum Purchase Required

Wine sales are possible only in Switzerland

For practical reasons packaging is proposed as follows:

  • 1 wine bottle, only for high-end wines (indicated on the Website)
  • 2 bottles of your choice (75cl)
  • 3 bottles of your choice (75cl)
  • 6 bottles of your choice (75cl)
  • 12 bottles of your choice (75cl)

Spirits or other beverages of a content less than or greater than 75 cl will be delivered separately

Food Products
A minimum order of CHF 100 is required

Any item out-of-stock will be indicated on the Website or communicated by email or telephone

Delivery costs in Switzerland and conditions
Delivery costs of wines, cosmetics and food products will be charged based on weight and distance as well as type of delivery

The company will cover delivery costs for any order of CHF 500 minimum in Switzerland

For express or special deliveries
Arrangements will be made exclusively by phone prior to any online purchase

Delivery costs within the European Union (EU)
For deliveries within the EU, all delivery and customs costs are borne by the buyer

Given that certain products cannot be sold outside of Switzerland, it is important to contact the company by email or telephone prior to any purchase

Deliveries can be made throughout Switzerland and the European Union (EU) as per stated conditions.

Merchandise cannot be collected at our depot

Deliveries are made via

  • PostPac Economy and/or Vinolog standard mail
  • Delivery van or specialized transporter

Delivery times
Delivery times vary based on product availability, supplier production constraints, national and international transportation, and other unforeseen conditions causing delivery delays

Smeralda cannot be held liable for delays in delivery for causes beyond its control

Payments are made via :

  • Six Payment Services: Visa, Mastercard, Maestro, VPay or American Express credit cards
  • Cantonal Bank of Geneva bank account
    IBAN No.: CH12 0078 8000 k329 6233 6 – Swift No. BCGECHGGXXX
  • Cash-on-delivery (COD), as per arrangements made during a telephone order

If you change your mind, you may cancel your order within 48 hours

If you have paid in the meantime, Smeralda reserves the right to refund you with a 10% deduction pf the value of the order in process.

The invoice related to an order paid in advance electronically will be sent along with the mail delivery or remitted along with a direct delivery

All prices are in CHF (Swiss Francs)

Only prices stated at the time of order are valid

Product Return and Refund
In Switzerland, it is in principle not possible, as per the law, to request a product exchange or refund merely because the product does not, or no longer suits you.

Accordingly and for the above reason, we do not accept returns nor product refunds for merchandise sent or delivered.

Any damage must be noted on the delivery bulletin.

It is your responsibility to check merchandise at delivery.

Signature on the delivery bulletin attests that the delivery has been correctly executed.

In case of damage during transport and that will have been notified by the deliverer, the goods may be refused and returned to the depot

If the damage has not be notified by the deliverer, it must be communicated within 10 days by registered letter detailed the nature of the damage

Only the damaged products of the order in question are to be returned to the Company’s address at the company’s cost by Postpack Economy in its original packaging, unopened and non-consumed.

Smeralda will not accept undamaged merchandise returned as part of the same return delivery

After validation of the damage, Smeralda Distribution SA will replace the damaged goods with delivery charges borne by the company. In case of an inventory break, Smeralda will inform you and decide an eventual refund of the damaged product or, with your agreement, its replacement by a similar product. According to the circumstances a purchase voucher may be proposed

Confidentiality and Data Protection
Your personal information (name & address, etc.) will not be sold nor transmitted to other agencies

If you wish to receive our publicity by mail or email, simply tick the box in the field « I accept to receive your advertising material in the area “Registration of your coordinates”

Company Data Protection
According to data protection laws, all texts and photographs belong exclusively to Smeralda Distribution SA and may not be used in any circumstance outside of the company website, reproduced or transformed by third-parties without the express authorization of the company

Quality Control
Each product is carefully checked prior to delivery and our packaging is secure

Jurisdication and Applicable Law
These sales terms and conditions are governed by Swiss law

The courts of law of Geneva Switzerland will prevail.
